About the presenters: Ashley McDonald and Kristy Xu

Ashley McDonald is a Partner in the WorkCover department. She has more than 22 years of experience acting for WorkSafe, self Insured employers and the TAC. Her practice focuses on serious injury, common law claims and litigation. 
 
Kristy Xu is a Senior Associate who also practises in the WorkCover department. Her expertise is in statutory benefits, claims management and early interventions.

Presentation will cover:

  • Suitable employment and Vocational Assessment Report
  • The presentation will be in three components.
  • Firstly, we will outline the legal context in which vocational assessment reports are considered with reference to the recent Court of Appeal case of Richter v Driscoll [2016]. We will explain the definition of “no current work capacity” and what we think is necessary to satisfy this test in light of court decisions.
  • Secondly, we will discuss how the courts have tended to view and respond to vocational assessment reports.
  • Lastly, we will provide practical tips on how to improve the 130 week termination process.
